Dial Telecom has filed objections against the tender for SMS messages of Dopravni podnik in Brno

Dial Telecom a.s. has filed objections against the entry conditions of the public procurement “The supply of a system for introduction of payments for fares through SMS messages” of Dopravni podnik (the public transit company) in Brno, the ordering party.

The reason for this is the highly non-standard course of action of this government procurement, starting with the entry documentation itself, which, according to Dial Telecom, contradicts the law.

“What we do not like are the excessive requirements, as well as the non-transparent criteria of the competition and that’s why we filed The Petition for Review of legal acts made by the ordering party into the hands of UOHS (Office for the Protection of Competition). Our aim is to make UOHS cancel this tender and announce a new one – a transparent tender, which will enable its participants to realistically meet the requirements of the ordering party,” says Robert Horáček, the product manager of Dial Telecom.

The ordering party, for example, requires a certificate be presented that guarantees the system is capable of processing a capacity of 20,000 SMS messages per minute for each seperate mobile operator’s network, which, with respect to the expected volume of use for this service is highly over-proportional. In Prague, for example, an average of about 30,000 SMS tickets are purchased per day.

We recognize another serious defect of the entry documentation in the way of assessing the complexity of the offered services. The ordering party set the assessment criterion of the complexity of the offered services with a weight of 45%, which is a weight capable of significantly influencing the assessment of the filed bids, but is not, in any case, a criterion which can be objectively assessed. The way in which a number of particular sub-criteria are described makes them incapable of becoming merely a subject of  contract assessment (e.g. the communication during the customer’s order of a ticket), etc.

It is Dial Telecom’s view that the entry documentation of the public procurement contradicts the law, particularly its essential principles. Dial Telecom requests the UOHS cancel the entry proceedings pursuant to §118 Article 1 of Law.
